Since the GSEs dominate the U.S. residential mortgage funding market today, it makes sense to view the potential future of covered bonds in the context of Fannie Mae’s and Freddie Mac’s current federal conservatorships. Jerry Marlatt, a partner in the New York office of UK-based law firm Clifford Chance, was involved in the first covered bond issuance in the U.S. (with WaMu). In this article for the ABA Banking Journal, he discusses factors that could promote the development of a U.S. covered bond market, including legislation.
